Welcome to Practical Cryonics. These Terms of Service ("Terms") govern your use of practicalcryonics.com, the book's companion site, the mailing list, and any related service (the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

0. Operator

This Site is operated by AcquisitionInvest, LLC, a Wyoming limited liability company ("Operator," "we," "us," or "our"). References to "you" or "your" mean the individual or entity accessing the Services. See the Contact section for legal-notice details.

1. Who We Are

"Practical Cryonics," "we," "us," or "our" refers to the operator of practicalcryonics.com, an informational and book-companion site authored by Trent Tompkins. You can reach us at the addresses listed under Contact below.

2. Educational Purpose — Not Medical or Legal Advice

The content on practicalcryonics.com, including the book Practical Cryonics, is provided for general educational and informational purposes only. It is not medical advice, legal advice, financial advice, or a substitute for consultation with a licensed physician, attorney, financial planner, or cryonics service provider. Decisions about end-of-life planning, medical care, biostasis, and estate arrangements should be made with qualified professionals who understand your individual circumstances. We make no warranty as to the accuracy, completeness, or current applicability of any specific claim, study, or procedure described on the site or in the book. Cryonics is an experimental procedure with no guarantee of successful future revival.

3. Eligibility

You must be at least 13 years old to subscribe to our mailing list or submit forms. If you are under 18 (or the age of majority in your jurisdiction), you may only use the Services with the consent of a parent or legal guardian. The Services are not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. See Privacy Policy for our COPPA practices.

4. Acceptable Use

You agree not to: (a) harass, threaten, or impersonate others when contacting us; (b) post or submit content that is unlawful, hateful, infringing, or that doxes another person; (c) attempt to probe, scan, or breach the security of the Services; (d) scrape, mirror, or re-host substantial portions of the Services without written permission; (e) use the Services to send spam, phishing, or malware.

5. Intellectual Property

The Practical Cryonics name, book text, cover art, photography, and underlying website code are owned by Trent Tompkins and protected by copyright. Except for fair-use commentary, quotation, and review, you may not copy, modify, or redistribute the book or site content without written permission. The book is sold through Amazon; purchases there are governed by Amazon's terms.

6. Text Messaging (SMS) Program

Practical Cryonics may operate an opt-in SMS program for book release updates, errata notifications, event announcements, and related project news.

6.1 Consent & Opt-In

You only receive SMS messages from Practical Cryonics after you affirmatively opt in by (a) checking an SMS opt-in box on a mailing-list signup form; or (b) texting a keyword such as JOIN to our long-code number. Your consent is not a condition of any purchase (the book is sold by Amazon under their terms). We retain a record of when, how, and for what purpose you opted in.

6.2 Message Types & Frequency

Message frequency varies. Typical promotional frequency is no more than 2 messages per month.

6.3 Message & Data Rates

Msg & data rates may apply. Your wireless carrier may charge you for sending and receiving text messages. Practical Cryonics is not responsible for carrier charges.

6.4 HELP and STOP Keywords

For help at any time, reply HELP to any Practical Cryonics message or email trent@practicalcryonics.com.

To opt out at any time, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any Practical Cryonics message. You will receive a single confirmation message and no further marketing messages from that program.

6.5 No Sale or Sharing of Opt-In Data

Practical Cryonics does not sell, rent, lease, share, or otherwise disclose your SMS opt-in information (your phone number and the fact that you consented to receive text messages) to any third party for marketing or promotional purposes. SMS opt-in data is shared only with our messaging service provider as needed to deliver the messages you requested. See Privacy Policy.

6.6 Supported Carriers

The SMS program is available on most major U.S. carriers, including AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Boost, MetroPCS, Cricket, and Virgin Mobile. Carriers are not liable for delayed or undelivered messages.

7. Email Communications (CAN-SPAM)

If you subscribe to our email list, every email includes a one-click unsubscribe link and our physical mailing address. You can also unsubscribe at any time by emailing trent@practicalcryonics.com.

8. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We make no representation that future revival of cryonically preserved individuals will ever be technologically possible.

9. Limitation of Liability

To the maximum extent permitted by law, Practical Cryonics's aggregate liability for any claim arising from the Services is limited to USD $100. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Dispute Resolution

Please read this section carefully. It significantly affects your legal rights, including the right to file a lawsuit in court.

10.1 Binding Arbitration (Pre-Litigation Requirement)

ARBITRATION. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any transaction or interaction with the Operator shall first be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules in Butler County, Pennsylvania, in English, before a single neutral arbitrator. THIS IS A PRE-LITIGATION REQUIREMENT — you agree to arbitrate before filing any lawsuit. The arbitrator’s decision will be final and may be entered as a judgment in any court of competent jurisdiction.

10.2 Class Action Waiver

CLASS ACTION WAIVER. You and the Operator agree to resolve all disputes individually. You waive the right to participate in any class, collective, representative, or consolidated action — whether in arbitration or court. No arbitration may be consolidated without all parties’ written consent.

10.3 Court Venue (Injunctive Relief or Arbitration Unavailable)

COURT VENUE. If arbitration is unavailable, refused by the arbitration provider, or for claims seeking injunctive or equitable relief, the EXCLUSIVE venue is the Court of Common Pleas of Butler County, Pennsylvania and the U.S. District Court for the Western District of Pennsylvania. You consent to personal jurisdiction therein. No claims may be brought in any other forum.

10.4 Governing Law

GOVERNING LAW. These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of the arbitration provision in Section 10.1.

10.5 Thirty-Day Arbitration Opt-Out

ARBITRATION OPT-OUT. You may opt out of the arbitration agreement in Section 10.1 within 30 days of your first acceptance of these Terms by emailing legal@practicalcryonics.com with the subject line "ARBITRATION OPT-OUT" and including "practicalcryonics.com" in the body. If you opt out, the court-venue clause in Section 10.3 governs all disputes; the rest of these Terms continue to apply.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on this page with a new effective date.
